From January 1st 2021, a two month independent entitlement is earned in cases of miscarriage after 18 weeks of pregnancy. The minimum period of maternity/paternity leave is two weeks, and the entitlement expires 24 months after miscarriage. 

In instances of miscarriages occurring after 18 weeks of pregnancy which occurred before January 1st 2021, parents earn a two-month shared entitlement to maternity/paternity leave. Parents can share this entitlement or one parent can use it entirely. The minimum period of maternity/paternity leave is two weeks and this entitlement must be used within two months from the day of the miscarriage. 

• In instances of stillbirth occurring after 22 weeks of pregnancy, each parent earns an independent entitlement to maternity/paternity leave for up to 3 months. The minimum period of a maternity/paternity leave is two weeks, and the entitlement expires 24 months after stillbirth. 

• In instances of stillbirth occurring before January 1st 2021, entitlements must be used in the next three months from the day of stillbirth. 
• Parents have a joint right to a three-month extension of maternity leave by three months for each additional still birth after 22 weeks of pregnancy. 

Required documents in addition to basic application documents: 

• Medical certificate or a confirmation from a hospital stating the period of pregnancy and the child’s maternal and paternal parents. 

• If a parent has submitted an application to the Maternity/Paternity Leave Fund before miscarriage or stillbirth, a new statement may have to be submitted about how the parental leave will be planned.
